Terms and Conditions
GENERAL PROVISIONS
By placing an Order on our online store at [www.axomebeauty.com], the Buyer, whether ordering as a Guest or a Registered User, confirms having read and accepted these Terms and Conditions, Privacy Policy, Refund and Complaint Policy and Shipping Policy.
If you are a Registered User and do not agree to these Terms and Conditions, please stop using your Account and delete it immediately in accordance with the procedure outlined in these Terms and Conditions.. If you are ordering as a Guest and do not agree to these Terms and Conditions, please do not proceed with your purchase.
DEFINITIONS
1. Account: A personal user profile created on the Website that allows Registered Users to manage orders and store personal details.
2. Buyer: A natural person (consumer) or a legal entity (company, organization) that places an Order on the online store at [www.axomebeauty.com], either as a Guest or a Registered User.
3. Guest: A Buyer who places an Order without creating an Account.
4. Registered User: A Buyer who has created an Account on the Website.
5. Order: A request placed by the Buyer to purchase one or more Products available on the Website. An Order is considered completed when the payment is successfully processed.
6. Payment: The process by which the Buyer completes the purchase of an Order using the available payment methods provided on the Website.
7. Privacy Policy: the set of rules and principles governing the collection, processing, storage and protection of personal data provided by Buyer while interacting with the Website.
8. Product: Any item available for sale on the Website. The Products comply with the legal requirements applicable within the territory of the European Union, including, but not limited to, Regulation (EC) No 1223/2009 of the European Parliament and of the Council on cosmetic products.
9. Policies: total designation for Refund and Complaint Policy, Privacy Policy and Shipping Policy.
10. Refund and Complaint Policy: The policy governing order cancellations, returns and refunds. Buyers may have the right to cancel or return products under specific conditions outlined in the Refund and Complaint Policy.
11. Services: Any functionality provided through the Website, including but not limited to browsing, purchasing Products, customer support, account management (for Registered Users) and other related features.
12. Seller: Synaxan Sp. z o.o., the owner of the AXOME brand, a company specializing in the sale of cosmetic products through its online store at [www.axomebeauty.com]. The terms “we”, “us” and “our” refer to the Seller. As the operator of the online store, AXOME is responsible for managing the Website, offering Products, processing Orders and providing customer support in accordance with the Terms and Conditions.
13. Shipping Policy: The process of delivering the purchased Products to the Buyer’s specified address.
14. Website: The online store operated by Synaxan Sp. z o.o., owner of AXOME brand, accessible at [www.axomebeauty.com], where Buyer can browse and purchase Products.
15. Terms and Conditions, Terms: The set of rules that govern the use of the Website, purchase of Products and provision of Service. The Terms and Conditions are available at [www.axomebeauty.com/pl/policies/terms-of-service].
PRODUCTS AND SERVICES
1. Certain Products and Services are available exclusively online in limited quantities. The Seller makes every effort to display accurate product images and descriptions; however, due to monitor settings and display variations, actual colors may differ.
2. The Seller reserves the right to:
a) Restrict sales to specific individuals, regions, or jurisdictions.
b) Limit the quantity of Products or Services per Buyer.
c) Modify descriptions, pricing or availability without notice.
d) Discontinue any Product or Service at any time.
e) Void any offer where prohibited by law.
3. The Seller may refuse, limit or cancel Orders at its sole discretion due to payment issues, stock unavailability, suspected fraud, misuse of the Website or violations of these Terms and Conditions. Orders placed by dealers, resellers or distributors may also be restricted. If an Order is modified or canceled, the Buyer will be notified using the contact details provided at checkout.
4. Purchase restrictions may apply per person, household, or order, including those that:
a) Use the same Buyer account.
b) Are placed with the same credit card.
c) Share the same billing and/or shipping address.
5. The Seller does not guarantee that any Product, Service or information will meet the Buyer’s expectations, nor that errors will always be corrected.
6. The Seller strives to ensure that all information on the Website is accurate and up to date. However, typographical errors, inaccuracies or omissions may occur, particularly regarding product descriptions, pricing, promotions and shipping details.
7. The information provided is for general reference only and should not be solely relied upon for decision-making.
8. The Buyer agrees to provide accurate, complete and up-to-date billing and account information for all purchases made through the Website. This includes promptly updating the Buyer email address, payment details, billing and shipping information as needed to ensure the successful processing of transactions and order-related communications.
LIABILITY
1. The Website may provide access to third-party tools or services that support certain functionalities, such as payment processing, shipping tracking or customer support. These tools are operated by independent providers and the Seller does not monitor, control or assume responsibility for their availability, performance or security.
2. By using the third-party tools, the Buyer acknowledges and agrees that they are provided "as is" and "as available" without warranties, guarantees or endorsements of any kind. The Seller is not liable for any issues, errors or damages resulting from their use.
3. Buyer use of any optional third-party services through the Website is at its own risk and discretion. It is Buyer responsibility to review and accept the terms and conditions set by the respective third-party providers before using their tools.
4. The Seller may introduce new services, features or integrations, including additional third-party tools. Any such additions will also be subject to these Terms and Conditions.
5. The online store on the Website is hosted on Shopify Inc., which provides the e-commerce platform that enables the Seller to sell the Products and Services. As a result, certain features and functionalities of the Website rely on Shopify’s infrastructure and third-party tools integrated into the platform.
6. The Seller does not guarantee, represent, or warrant that the Buyer’s use of the online store and services will be uninterrupted, timely, secure, or error-free. While the Seller strives to provide accurate product information and a seamless shopping experience, no guarantee is made that the results obtained from using the Website or Services will always be accurate, complete or reliable.
7. The Buyer acknowledges and agrees that the Seller may, from time to time, modify, suspend or discontinue any part of the Services, either temporarily or permanently, without prior notice.
8. The Buyer’s use of the Website, Services and any Products purchased through the store is at their sole risk. Unless explicitly stated otherwise by the Seller, all Products and Services are provided "as is" and "as available", without any warranties, express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement.
9. Under no circumstances shall the Seller, its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be held liable for any injury, loss, claim, or direct, indirect, incidental, punitive, special or consequential damages arising from:
a) The Buyer’s use of or inability to use the Website, Services or Products.
b) Errors or omissions in any content on the Website.
c) Any loss or damage caused by the use of the Website, its content, or any Product purchased, whether due to negligence, contract breach, strict liability or any other legal basis.
10. This limitation of liability applies even if the Seller has been advised of the possibility of such damages.
11. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the Seller’s liability in such jurisdictions shall be limited to the maximum extent permitted by law.
BUYER AND ACCOUNT
1. To access personalized features and manage your purchases, the Buyer may create an Account on the Website. The account creation process is as follows:
a) Initiating Account Creation: On the Website, select the "Create Account" option. The Buyer will be prompted to provide a valid email address.
b) Email Verification: After entering the email address and clicking "Continue," a unique verification code will be sent to the provided email address.
c) Code Confirmation: Upon receiving the email, enter the verification code into the designated field on the website and submit it to complete the account creation process. No password is required for account setup or subsequent logins.
2. Once the code is verified, the Buyer will be automatically directed to the "Orders" page, where the Buyer can view the purchase history and manage the Account details.
3. To log in to the Account:
a) Enter the registered email address on the login page.
b) Click "Continue" to request a new verification code, which will be sent to the email.
c) Input the received code to gain access to the account. No password is required, as the system relies solely on email-based verification for security.
4. After logging in, the following options are available within the Account:
a) Orders: This section displays the order history, including details of past and current purchases. It serves as the default landing page after Account creation or login.
b) Profile: The "Profile" option allows the Buyer to view and update its personal information, such as name and contact details, associated with the Account.
c) Settings: Under the "Settings" menu, the Buyer can configure account preferences and security options, including:
○ Log Out Everywhere: Selecting this option will immediately log you out from all devices where your account is active. Upon subsequent login attempts, a new verification code will be required.
5. To delete the Account, the Buyer must submit a request by sending an email to [hello@axomebeauty.com]. Upon receiving the request, the Seller will process the account deletion in accordance with applicable data protection regulations. Please note that account deletion is irreversible and will result in the permanent removal of the account data, including order history and profile information, subject to any legal retention obligations.
6. The Account system prioritizes security by utilizing one-time verification codes sent via email, eliminating the need for a traditional password. The Buyer is responsible for maintaining the confidentiality of the email account, as it serves as the primary means of accessing the Account. In the event of unauthorized access, use the "Log Out Everywhere" feature to secure the Account.
PAYMENTS
1. Purchases can be made without registering an Account, allowing Buyers to place orders as guests.
2. The Seller offers secure payment processing through the following providers:
a) Stripe (supports): Visa, Mastercard, American Express.
b) PayU GPO (supports): Visa, Mastercard, BLIK, PayU.
c) Klarna
3. Payments are currently accepted in Polish Zloty (PLN). The Seller may introduce additional currencies.
4. All transactions are encrypted and securely processed through trusted third-party payment providers.
5. The Seller does not store or process credit card details directly.
6. Orders are processed only after successful payment authorization.
7. If payment is declined, incomplete or flagged for security reasons, the Seller reserves the right to cancel the Order.
8. The Buyer is responsible for providing accurate billing details.
9. If billing discrepancies occur, the Seller may request additional verification before processing the Order.
10. All prices displayed on the Website are gross (include all taxes).
11. A fiscal receipt is issued for each order. A VAT invoice is available upon request; the Buyer should include a note in the remarks section on the shopping cart page. The Buyer must provide accurate invoicing details at the time of purchase. The Seller will then send the invoice via the email provided.
12. The price of a Product at the time of placing an Order is binding and will not change after the Order is confirmed.
13. Product prices do not include shipping costs, which are calculated separately at checkout.
ACCEPTABLE USE
1. By using the Website and agreeing to the Terms and Conditions, the Buyer confirms that the Buyer is at least the age of majority in its country, state or province of residence. If the Buyer is under the age of majority, the Buyer may use the Website only with the consent and supervision of a parent or legal guardian.
2. The Buyer may not purchase the Product for resale, distribution or any other commercial purpose without the Seller’s explicit consent.
3. The Buyer agrees not to use the Website or Services for any unlawful or unauthorized purpose. In particular, the Buyer must not:
a) Provide false or misleading information when placing an Order, creating an Account or submitting product reviews.
b) Attempt to fraudulently obtain refunds, discounts or promotions not intended for the Buyer.
c) Resell or distribute the Products in a way that violates consumer protection laws or falsely represents an association with the Seller and its brand.
d) Tamper with, modify or counterfeit the Products in any way.
e) Attempt to interfere with the functionality or security of the Website, including but not limited to introducing viruses, worms or malicious code.
4. When using the Website and its content, the Buyer is strictly prohibited from engaging in any activities that:
a) Violate any applicable laws or regulations, including international, national, federal, state, provincial or local laws.
b) Encourage or solicit unlawful acts by others.
c) Infringe upon intellectual property rights, including Seller’s brand, trademarks or copyrights or those of third parties.
d) Submit false, misleading, or fraudulent information, including fabricated Product reviews, unauthorized claims about the Products or misrepresentation of Buyer’s identity.
e) Harass, abuse, insult, defame, slander, discriminate or intimidate others based on gender, sexual orientation, religion, ethnicity, race, nationality, disability, age or any other protected characteristic.
f) Upload or distribute viruses, malware, or malicious code that could harm the functionality of the Website, its Services, other websites, or online networks.
g) Collect, track, or misuse personal data of other Buyers, including email addresses and payment details.
h) Engage in spamming, phishing, hacking or any form of fraudulent online activity that disrupts Website operations or user experience.
i) Bypass or interfere with security measures related to the Website, platform, or any linked services.
j) Use the website or its content for any obscene, immoral, deceptive or unethical purpose.
k) Manipulate, exploit, or abuse the Services, including unauthorized resale of Products to bypass purchasing limits or any fraudulent returns or chargebacks.
6. Any breach of the Terms and Conditions, including misuse of the Website or violation of applicable laws, may result in the immediate termination of Buyer’s access to the Service or Account (if applicable) and, if necessary, legal action.
7. The Buyer acknowledges that any content the Buyer submits to the Website (excluding payment information) may be transferred unencrypted across networks to ensure compatibility with technical requirements. However, all credit card and payment information is securely encrypted during transmission over networks in accordance with industry security standards.
SHIPPING POLICY
1. Orders are shipped to the delivery address provided by the Buyer at the time of purchase. Shipping times and costs vary based on location, selected shipping method and any applicable customs regulations.

PRIVACY POLICY
1. Any personal information the Buyer provides through the Website is processed in accordance with the Privacy Policy. By using the Website and Services, the Buyer consent to the collection, use and storage of its data as outlined in the Privacy Policy.

COMPLAINTS AND RETURNS
1. The Seller's liability for physical or legal defects in the Products sold is governed by applicable laws, including the Polish Civil Code.
2. The complaint and returns procedure does not limit the consumer’s statutory rights under Polish law.

GOVERNING LAW
1. These Terms and Conditions, along with any separate Policies under which the Seller provides Services to the Buyer, shall be governed by and interpreted in accordance with the laws of Poland. Any disputes arising from or related to the Terms and Conditions or Policies shall be subject to the exclusive jurisdiction of the competent courts in Poland.
2. In matters not regulated by the Terms and Conditions and Policies, the provisions of the Polish Civil Code and other applicable provisions of Polish law shall apply.
ENTIRE AGREEMENT
1. The Seller failure to exercise or enforce any right or provision of the Terms and Conditions shall not be interpreted as a waiver of such right or provision.
2. The Terms and Conditions, together with any Policies or operational rules published on the Website in relation to the Service, constitute the complete and exclusive agreement between Buyer and Seller.
3. The Terms and Conditions govern the use of the Service and supersede any prior or contemporaneous agreements, communications or proposals, whether oral or written, between Buyer and Seller, including any previous versions of the Terms and Conditions.
4. If any provision of the Terms and Conditions is found to be unlawful, invalid or unenforceable, it shall be enforced to the maximum extent permitted by applicable law. The unenforceable portion shall be deemed severed from the Terms and Conditions, without affecting the validity or enforceability of the remaining provisions, which shall continue to remain in full force and effect.
5. The section headings in the Terms and Conditions are included for convenience only and do not affect the interpretation of these Terms.
AMENDMENTS TO THE TERMS AND CONDITIONS
1. The most up-to-date version of the Terms and Conditions is available on the Website and may be reviewed at any time.
2. The Seller reserves the right, at our sole discretion, to modify, update or replace any provisions of the Terms and Conditions and Policies by publishing the revised version on the Website. Any such changes become effective immediately upon posting, unless otherwise stated.
3. It is the responsibility of the Buyer to periodically review these Terms and Conditions and Policies for updates. Continued use of the Website after the publication of changes constitutes acceptance of the revised Terms and Conditions and Policies.
4. If the Buyer does not agree to the updated Terms and Conditions or Policies, the Buyer should discontinue the use of the Website immediately.
BUYER REVIEWS AND FEEDBACK
1. If the Buyer wishes to submit a review of a purchased Product, the Buyer shall send it via email to [hello@axomebeauty.com].
2. The reviews should be written in Polish or English while adhering to proper language and grammatical standards.
3. Submitted reviews must not:
a) Contain unlawful, offensive, vulgar, defamatory, misleading or inappropriate content, nor infringe upon the rights of third parties.
b) Be copied or duplicated from another review, whether in whole or in part.
c) Include links, references to external websites, advertisements, promotional material or spam.
d) Disclose personal or contact information of the reviewer or any third party.
e) Refer to products that were not actually purchased or used by the reviewer.
4. A valid review should:
a) Include the reviewer's designation (name or nickname).
b) Provide an honest, detailed opinion reflecting personal experience with the purchased Product.
5. All submitted reviews are subject to verification. The Seller may contact the reviewer to confirm the authenticity of their feedback.
6. The Seller reserves the right to refuse publication of any review that does not comply with these Terms and Conditions, contains misleading or inappropriate content or otherwise violates the Policies. Additionally, the Seller may remove any previously published review if new information suggests it does not meet the standards.
7. By submitting a review, reviewer grants the Seller the right to use, publish and display its feedback in accordance with the Policies and Terms and Conditions.
